ABA Business Law Section Honors Bradley Arant Partner Scott E. Ludwig With 2010 Section Chair’s Award
Bradley Arant Boult Cummings LLP is pleased to announce that the ABA Business Law Section has honored partner and Life Sciences Industry Team chair Scott E. Ludwig with its Section Chair’s Award for 2010. The outgoing Section chair gives the annual award to an individual who has made extraordinary contributions over the course of the previous year. Mr. Ludwig received the 2010 award from outgoing chair Nathaniel L. Doliner during the recent ABA Annual Meeting held in San Francisco.
“Scott Ludwig provided outstanding leadership to the Business Law Section in the development of a business plan for the preparation, production and marketing of continuing legal education materials,” said Doliner. “He truly deserves this award.”

Clarence Webster, an associate in the firm's Jackson office, was recently appointed to serve as the 2010-2011 Issues and Resolutions Committee Chair for the National Bar Association Young Lawyers Division. As the Issues and Resolutions Committee Chair, Clarence will be responsible for drafting and reviewing resolutions to be presented to the NBA Board concerning any and all YLD issues.

Two Bradley Arant Boult Cummings Attorneys Named to Mississippi Secretary of State Study Group on Technology and IP
Bradley Arant Boult Cummings LLP is pleased to announce that partner David K. Pharr and special counsel Wendy R. Mullins have been named to the Mississippi Secretary of State’s Technology and Intellectual Property Study Group.
The group, formed by the Policy & Research Division of the Secretary of State’s office, is tasked with studying Mississippi law regarding technology and intellectual property, making recommendations to the legislature, formulating the recommendations into proposed legislation, and reviewing proposals with members of the legislature. In particular, the group will be asked to consider possible revisions to the Mississippi Uniform Trade Secrets Act concerning the adoption of a right to publicity statute, whether and how to adopt incentives to attract technology companies to the state, and whether to adopt legislation regarding electronic transactions and software contracts.

Jason Bushby Selected to Participate in the Birmingham Bar Association’s 2010 Future Leaders Forum
Jason Bushby, an associate in our Birmingham office who practices in the Insurance and Financial Services practice groups, was recently selected to participate in the Birmingham Bar Association’s 2010 Future Leaders Forum. The Future Leaders Forum Task Force selected Jason amongst a host of applicants in the Birmingham legal community. The program consists of five different sessions focusing on defining the highest ethical standards for attorneys, encouraging diversity in the practice of law, enhancing relationship-building skills, developing knowledge of the community, promoting public trust in the profession and balancing work and life.

Matt Lembke Elected to Chair-Elect of ABA’s Council of Appellate Lawyers
At the ABA Annual Meeting, Matthew H. Lembke, a partner in the firm's Birmingham office, was elected to be Chair-Elect of the ABA’s Council of Appellate Lawyers. He will serve as Chair in 2011-12.
The Council of Appellate Lawyers (CAL) is the first and only national appellate bench-bar organization in the country. Founded in 2000, CAL’s mission is to foster a dialogue among federal and state appellate lawyers and judges that will improve appellate advocacy and strengthen ties among the numerous federal, state, and local appellate bar associations. Often working with the Appellate Judge’s Education Institute (AJEI), CAL sponsors and develops continuing legal education programs taught by the country’s most celebrated appellate judges and practitioners.

BABC Wins Multi-Million Dollar Securities Appeal in Eleventh Circuit
On July 30, the Eleventh Circuit reversed a $31.7 million securities-fraud judgment that had been entered against Southern Farm Bureau Life Insurance Co. In a
27-page opinion, the court of appeals held that the district court had erred in instructing the jury that Southern Life, as the buyer of a security in an arm’s-length transaction, had a duty to disclose transaction-related information directly to its counterparty’s shareholders. BABC partner
