After Four Years, Southern Living Reaches Favorable Settlement in Copyright Suit

In hotly contested case (William E. Poole Designs, Inc. v. Southern Living, Inc.) that was litigated for more than four years, lawyers in the Intellectual Property Group defended Southern Living against copyright infringement claims in which the plaintiff alleged infringement of numerous house plans and artists renderings. On behalf of Southern Living, radley Arant Boult Cummings also asserted counterclaims of trademark infringement in which we claimed that the plaintiff and its principal owner infringed the SOUTHERN LIVING mark by using the term in Google and Yahoo key word advertising campaigns, in its web site metatags and other ways on its web site. Just before the case was settled in November 2008, the plaintiff had increased its damages claim to over $100 million. However, a very favorable settlement was reached within a few days of a hearing on Southern Living’s Daubert motion to exclude Plaintiff’s expert witnesses, and also on a motion for sanctions.
