Dismissal with Prejudice for Former President of W.R. Grace’s Construction Products Division

Bradley Arant Boult Cummings represented Robert C. Walsh, the former President of the Construction Products Division of W. R. Grace in the 1980s. In February of 2005 in United States District Court in Missoula, Montana, Walsh and seven other defendants were indicted with conspiracy to defraud the United States and violate the Clean Air Act. The EPA claimed in 2005, the Indictment represented the most important environmental prosecution ever brought. The case alleged a nearly 30 year conspiracy with hundreds of witnesses, dozens of experts, and millions of documents involving violations of the Clean Air Act relating to asbestos releases in the town of Libby, Montana, obstruction of Justice and a conspiracy to Defraud the EPA and NIOSH. On behalf of Mr. Walsh, the defense team aggressively challenged every piece of evidence that the prosecutors attempted to use. After our team filed a Motion for Judgment of Acquittal on behalf of Walsh, the government conceded that there was insufficient evidence for the case to go to the jury. On the government’s motion, a dismissal of the indictment with prejudice was granted on April 27, 2009, in favor of the firm’s client.
