Mr. Hirsch has deep litigation and commercial law experience involving real estate acquisitions, real estate development, title litigation, condemnation, state and federal court receiverships, professional liability defense (attorneys, directors and officers), business torts, defamation, creditors’ rights, RICO, securities, secured and unsecured financing, factoring and constitutional litigation.
Mr. Hirsch’s commercial law experience is reinforced by his representation of numerous corporations, partnerships and joint ventures which experienced a wide variety of internal governance problems, including deadlock. This experience has attracted a diverse clientele of principals of such entities (majority as well as minority ownership interests), high net worth individuals, present and former officers and directors of operating companies for whom Mr. Hirsch regularly provides advice on non-litigation strategies for resolving complex business disputes. These matters also include disputes between members of the same family whose business and personal relationships have fallen into disharmony.
Mr. Hirsch has also served as an expert witness in state and federal court litigation on a number of issues, including corporate governance, fraudulent conveyances and preferential transfers, administration of business affairs during a Chapter 11 reorganization, custom and usage involving the utilization of term sheets and reasonableness of fees.
