This includes major industrial and manufacturing companies, environmental consulting firms, remediation contractors, real estate companies and developers, financial institutions, individual property owners, and health care organizations.
At a time when most businesses, regardless of size or industry, are faced with increased environmental scrutiny and regulation, we guide clients through the complex compliance issues presented by federal, state, and local regulations. We provide counsel regarding liability avoidance and regularly represent clients before administrative boards as well as trial and appellate courts.
A particular focus of the group’s work involves advising real estate buyers, sellers, developers, and financiers on potential environmental issues. We regularly conduct environmental due diligence reviews and liability assessments on behalf of lenders, as well as those purchasing property or businesses. Our clients come to us for advice about real estate transactions where environmental issues are apparent – such as underground storage tanks, asbestos, and general environmental warranties and representations – as well as those in which the environmental issues may not be as obvious, but must be thoroughly investigated. The group also works with real estate holding companies in connection with landfill closures, hazardous waste landfill and surface mining permits, wetlands issues, and routine Phase I audits and remediation.
The firm’s litigators regularly represent clients on environmental and toxic tort matters before state and local courts, including cases involving toxic exposure to asbestos, benzene, silica, coal dust, and PCBs. We work on matters involving Superfund and CERCLA, as well as the Clean Water Act and Clean Air Act. We have extensive experience appearing before state and federal appellate courts, serving as counsel in many of the key cases that have shaped the country’s toxic tort litigation landscape.
