Experience

Represented policyholder, America Service Group Inc., in this dispute regarding whether a prior acts exclusion applied to a claim under an excess D&O policy. Case successfully resolved in mediation.
Represented General Motors in multiple cases seeking insurance coverage for the manufacturer’s historic asbestos and environmental liabilities. Successfully settled the disputes for a confidential amount.
Represented both amicus Gases and Welding Distributors Association (the umbrella membership association for welding rod distributors and manufacturers), and the policyholder, Clendenin Brothers, Inc. After persuading the district court to certify the question of first impression to the state court, obtained a ruling from Maryland’s highest court in favor of the policyholder and rejecting the insurer’s pollution exclusion defense. Subsequently also obtained attorneys’ fees.
Obtained reinsurance coverage in this dispute with a reinsurer over health care claims.
Represented policyholder, Magellan Health Services, in this reinsurance dispute. Case successfully resolved.
Served as Special Insurance Coverage Counsel for the debtor and represented the debtor in all insurance matters.
Represented hundreds of independent payphone providers in dispute over end user common line charges and crafted a strategy that led to the recovery of millions of dollars for the clients. The court of appeals affirmed a FCC ruling requiring defendants to refund end user common line charges wrongfully collected from independent payphone providers.
