The Boult Cummings Senior Housing and Long Term Care team invites you to attend a complimentary seminar to discuss the impact of the Long Term Care Community Choices Act (LTCCCA), which will soon be signed into law here in Tennessee.
On May 21st, the Tennessee Legislature completed its passage of landmark legislation affecting long term care services in Tennessee. The LTCCCA (SB4181/HB4144 ) reorganizes and reorders many, if not all, aspects of the coverage, regulation, and reimbursement of long term care services under TennCare. The legislation passed the House and Senate without a dissenting vote and awaits the signature of Governor Bredesen, who made its passage a key legislative goal. The legislation is comprehensive, but its main elements include:

Integration of long term care services into the current capitated TennCare system under the TennCare managed care organizations (MCOs), with a single entry point for Medicaid beneficiaries into the LTC system.

Creation of level of care criteria for long term care services so that the LTC system increases the use of home and community based services (HCBS) as an alternative to institutional providers, commonly called “rebalancing”.

The development and implementation of an acuity-based, price-based reimbursement system for nursing facility services as an alternative to the current cost-based reimbursement system

Expanded assisted-care living facility (ACLF) scope of services through changes in the current statutory provisions regarding assisted-care living facility admission and continued stay criteria. The legislation allows ACLFs to expand their services to additional individuals (both Medicaid and private pay) to permit persons to “age in place”.
