Mike practices in Financial Services Litigation with an emphasis in mortgage litigation and compliance and commercial/real estate litigation. Mike has litigated cases involving causes of action for violations of TILA, RESPA, FDCPA, FCRA, RICO, mortgage related fees and services, title insurance, wrongful foreclosure, and state deceptive trade practices law from Washington DC to South Carolina in both state and federal court. Mike also participated in the negotiation of a settlement agreement and consent order between the five largest mortgage servicers and the U.S. Department of Justice for alleged violations of the Servicemember Civil Relief Act (“SCRA”). He also supervises mortgage services litigation for clients of the BABC financial services litigation team in five states throughout the Southeast.
As a member of the Financial Services Litigation team, Mike leverages technology for the benefit of firm clients through an extranet, whereby clients have access to a BABC website that allows them to retrieve and open documents from multiple files. The extranet acts as a real-time, paperless file that can be accessed at all times regardless of location. Because security is a priority, the site is password protected and maintained by BABC’s Information Technology Department. His insurance litigation experience includes complex litigation related to coverage issues, bad faith, and fraud. He has also represented corporate clients in business tort actions and employment covenant disputes in state and federal court in North and South Carolina.
