Marc James Ayers is a member of Bradley Arant Boult Cummings LLP's Appellate Litigation Group. He represents individual, corporate and governmental clients before state and federal appellate and trial courts. Marc is listed in Best Lawyers in America in the field of Appellate Law, and has handled numerous appeals in the U.S. Courts of Appeals, the Alabama Supreme Court, the Alabama Court of Civil Appeals, and other state appellate courts. He has also represented clients on petitions for certiorari and amicus curiae briefs to the U.S. Supreme Court.  From 2008-2010, Marc served as Chair of the Appellate Practice Section of the Alabama State Bar. Marc currently serves as General Counsel to the Alabama Senate Republican Caucus.

Marc clerked for Alabama Supreme Court Associate Justice J. Gorman Houston, Jr. (1998-99), and later served as Justice Houston’s senior staff attorney (2001-2004). Between those positions, Marc was in private practice, specializing in appellate litigation and constitutional and administrative law. During that time, he also taught as an adjunct professor of law, teaching First Amendment Law, Administrative Law, Public Interest Law, and legal writing/appellate advocacy.

Marc received a B.A. from Florida State University (Philosophy, 1993), and later undertook graduate studies in theology and apologetics at Reformed Theological Seminary. He received his J.D. from Cumberland School of Law at Samford University (1998), where he was the Research and Writing Editor for the American Journal of Trial Advocacy.

Marc is frequently invited to lecture on Alabama appellate practice, and is the author of several articles on that subject, among others. Recently, the Justices of the Alabama Supreme Court recommended his article on certiorari practice to the entire Alabama Bar. Marc is also a member of the Amicus Curiae Committee of the Alabama Defense Lawyers Association.

Experience

Marc has handled numerous appeals in various jurisdictions, but has an extensive background in and focus on Alabama's appellate system. He has particular experience in cases involving constitutional litigation, civil rights, arbitration, statutory construction, election law, taxation and issues relating to punitive damages awards. Marc is also heavily involved in debates on important matters of public policy, and has been called on to file amicus curiae briefs in the United States Supreme Court and other courts on such matters as the impact of private gun ownership under the Second Amendment, constitutional standards of judicial recusal, and others.

Marc is married to the former Donna Tucker of Mobile, Alabama, and they have four children: Marc Jr., Julia, Tucker and new baby boy Charles.  Marc is active in his local parish, where he teaches various subjects including theology, apologetics and Church history. He also stays involved in various political and charitable activities, and enjoys public speaking and debate. Marc has published articles on various matters of public policy and has been the featured speaker regarding those matters on television and radio and before numerous groups.
