Represented the purchaser of oil and gas rights in a suit in which the landowner failed to transfer good title and alleged negligence on the part of our client. Obtained a judgment following trial for return of the entirety of the client’s funds, with interest.

Served on the national team for preparation and defense of sales representatives for depositions and served as part of the trial team for Albright v. Merck, in the Circuit Court of Jefferson County, Alabama; CV-05-2316. Three week jury trial resulted in defense verdict.

Representation of Dryvit Systems, Inc., the nation’s largest synthetic stucco manufacturer, throughout Alabama and Mississippi against claims sounding in products liability, fraud, negligence, and state consumer protection laws. This representation included defeat of a putative class action filed against Dryvit in Alabama state court, removal and transfer of numerous cases from Alabama state courts to an MDL set in North Carolina, and coordination of discovery between MDL and state court matters. Through this representation, we were able to obtain a dismissal of all lawsuits brought by subsequent purchasers of Dryvit clad residential structures based upon the doctrine of Caveat Emptor.

Representation included defense of personal injury as well as property/remediation damages.

Representation of Sears Roebuck & Co. throughout Alabama in cases filed by Plaintiffs asserting product liability and fraud claims against Sears related to vinyl siding sold to consumers across the state. This representation included litigation of class allegations, joinder of multiple plaintiffs with diverse claims, to the ultimate successful resolution of all pending claims.

The firm represented Ally Financial, Inc, Residential Capital, LLC and GMAC Mortgage in the largest national joint state/federal government settlement in history. The case began with “robo-signing” investigation and then broadened into examination of the mortgage industry. The case involved 49 state attorney generals, 48 state banking departments, the Department of Justice, the Department of Treasury, the Department of Housing and Urban Development, the Consumer Financial Protect Bureau, and the Federal Trade Commission. The closely-watched and widely publicized case is precedent-setting in that it established national mortgage loan servicing standards. We represented our clients in successfully negotiating and advocating that, based on the clients’ past leadership in the loan modification/loss mitigation area, even during the worst economic conditions in decades, they should receive a reduced settlement amount. In addition, we negotiated a different consumer relief structure as part of the settlement that recognized the clients’ past accomplishments in loan modification/loss mitigation. Court entered the Consent Order on April 5, 2012 in the District Court for the District of Columbia. The total settlement amount was $25 Billion. Our client paid $309 Million.
