Arlan D. Lewis

Arlan Lewis is a partner in the firm's Construction & Procurement and Government Contracts Practice Groups. An architect by education, Arlan's strong interest in the construction industry is evident in his representation of owners, contractors, subcontractors, developers, suppliers, and to a limited extent, design professionals, on a variety of issues arising out of complex commercial construction projects in the private and public sectors.

Arlan regularly represents construction industry clients in all aspects of litigation in state and federal courts in several jurisdictions around the country, and on occasion, internationally. In the litigation context, Arlan's involvement often begins when a dispute has arisen, or is anticipated, and continues through discovery, alternative dispute resolution procedures (including mediation and arbitration), settlement negotiations and, if unsuccessful, trial. Arlan has also gained substantial experience in advising clients concerning licensing and compliance issues, the negotiation, drafting and review of contract documents, and a variety of issues which arise during the performance of a project.

Experience

  • Representation of developer in arbitration regarding construction defect claims on multi-million dollar project in Idaho;
  • Advise major corporate owner regarding various issues on multiple construction projects in California, Colorado, and New Jersey;
  • Representation of major corporate owner in drafting and negotiation of all design and construction contracts for $350+ million project;
  • Representation of owner in termination for convenience claim;
  • Representation of international contractor on multiple federal projects for the U.S. Gen. Services Administration;
  • Defense of specialty subcontractor in class action lawsuit;
  • Claim preparation and litigation on behalf of an international company regarding a coke-handling facility in Aruba;
  • Representation of international specialty contractor regarding U.S. Dept. of Justice investigation;
  • Litigation, contract and settlement advice on behalf of a national contractor regarding a convention center in Texas;
  • Representation of contractor converting termination for default into termination for convenience and related claims on a federal contract;
  • Litigation regarding construction of a major corporate headquarters facility in McLean, VA;
  • Litigation, contract and settlement advice on behalf of national contractor regarding a shipbuilding facility in Maine;
  • Contract and close-out advice on behalf of national contractor regarding wastewater treatment facility in Alabama;
  • Litigation and settlement advice on behalf of a national contractor regarding a large wastewater treatment facility in Boston, MA
