Stagnant or decreasing reimbursement and other market factors have resulted in the practices of medical professionals such as physicians and others needing to be more proactive in identifying opportunities for growth and increased revenue. Our health care attorneys work with a number of physician practices, both small and large, in assessing opportunities for new business ventures, including joint ventures, the addition of ancillary services, and strategic growth through hiring of new physician employees. Our health care attorneys also work with a number of dental practices, psychologist practices and other health care professionals on similar issues. Our work with these groups includes organizational and internal governance issues, as well as advice on compensation formulas and methodologies. We also have significant experience working on acquisitions and divestitures of physician and other professional practices. We frequently advise professionals such as physicians on managed care contracting issues, as well as resolution of disputes with payors. In addition, we have assisted physician practices in the formation of independent practice associations (IPAs) and other provider networks.

Currently, our physician practice clients include a faculty practice plan with over 1,000 physicians, one of the largest cardiology practices in the state of Tennessee, a 30 physician radiology practice, a large pathology practice, a large oncology practice, the largest psychiatric and psychologist practice in Alabama and many smaller physician specialty and primary care practices.
Physicians and other health care professionals are under increasing regulation by State and Federal authorities, and our work with our health care professional clients includes advice and the development of policies to remain compliant with regulations, as well as representation when they are being scrutinized by governmental authorities, whether it be for alleged reimbursement violations, or for alleged professional licensure problems.
In addition to working directly with professional practices, we also have extensive experience representing hospitals and practice management companies in their management and employment of physicians and other professionals. In our work with these clients, we have evaluated and provided advice on compliance with fee-splitting and corporate practice of medicine laws in many states. In addition, we have assisted hospital clients in establishing hospital-owned “group practices” in several states in compliance with the federal Stark Law.
