Russ Morgan and Josh Phillips represented Pfizer on a claim for personal injuries resulting the plaintiff’s long term use of Dilantin®. The plaintiff claimed that, as a result of his use of Dilantin®, he developed ataxia and peripheral neuropathy. Plaintiff claimed he was unable to walk and his entire life was impacted. Plaintiff claimed $2.25 million in damages. The District Court granted the client’s motion for summary judgment based upon the statute of limitations. The statute of limitations defense was developed, in significant part, from the deposition one of plaintiff’s treating physicians taken by Mr. Morgan.
