      Blue Cord Design and Construction, LLC, SBA No. CVE-100-P (2018)
      Successfully represented the intervenor-awardee in a bid protest before the Small Business Administration (SBA) Office of Hearings and Appeals (OHA) involving the awardee’s eligibility for participation in the Department of Veterans Affairs’ (VA) veteran-owned small business (VOSB) and service-disabled veteran-owned small business (SDVOSB) program, known as the Center for Verification and Evaluation (CVE) Veteran Information Pages (VIP) database. The SBA OHA’s decision in this case was its first-ever decision on a CVE protest under the SBA OHA’s recently expanded jurisdiction.

      Successfully represented the intervenor-awardee, ServiceSource Inc., in a U.S. Court of Federal Claims bid protest involving the award of the National Geospatial-Intelligence Agency West Base Operations Services contract under the AbilityOne Program. The court upheld the Agency’s decision to award the subject contract – which is worth approximately $71 million – to ServiceSource, Inc.

      Assisted in the successful representation of construction contractor, Metcalf Construction Company Inc., in a high-profile appeal before the U.S. Court of Appeals for the Federal Circuit. Among other things, the case likely will set the standard for many years to come on the implied duty of good faith and fair dealing for federal government contracts.

      Successfully represented the protester, Integrated Nuclear Production Solutions LLC, in a GAO bid protest involving the largest contract ever awarded by the U.S. Department of Energy – a $22.8 billion contract for the consolidation of management and operating activities at the National Nuclear Security Administration’s Y-12 National Security Complex, in Oak Ridge, Tennessee, and NNSA’s Pantex Plant near Amarillo, Texas.
