    • Akima Intra-Data, LLC v. United States, COFC No. 14-378C (2014)
      Successfully represented the intervenor-awardee, ServiceSource, Inc., in a U.S. Court of Federal Claims bid protest involving the award of the National Geospatial-Intelligence Agency West Base Operations Services contract under the AbilityOne Program. The court upheld the agency’s decision to award the subject contract – worth approximately $71 million – to ServiceSource.

      Successfully represented the intervenor-awardee, Jacobs Technology Inc., in a GAO bid protest involving a $70 million task order awarded by the Department of the Navy, Naval Air Warfare Center Weapons Division, for information technology systems and services, primarily at China Lake and Point Mugu, California.

      Represented the protester, PIKA-PIRNIE JV, LLC, in a GAO bid protest challenging the award of a task order issued by the U.S. Army Corps of Engineers for remedial excavation services. The Army Corps of Engineers took comprehensive corrective action in response to the protest that we filed.

      Represented protester in a GAO protest challenging the U.S. Army Corps of Engineers’ evaluation of its technical proposal. GAO sustained the protest and recommended the Corps of Engineers reevaluate the protester’s proposal.

      Nuclear Production Partners, LLC and Integrated Nuclear Production Solutions, LLC, et al., B-407948  (2013)
      Successfully represented the protester, Integrated Nuclear Production Solutions, LLC, in a GAO bid protest involving the largest contract ever awarded by the U.S. Department of Energy – a $22.8 billion contract for the consolidation of management and operating activities at the National Nuclear Security Administration’s (NNSA) Y-12 National Security Complex in Oak Ridge, Tennessee, and NNSA’s Pantex Plant near Amarillo, Texas.

      Represented the protester in a GAO protest challenging the U.S. Army Corps of Engineers’ past performance evaluation in connection with a solicitation for construction services. The agency promptly took corrective action in response to the protest that we filed.

      Black & Veatch Special Projects Corporation, B-408607 (2013)
      Successfully represented the intervenor-awardee, CH2M Hill, Inc., in a GAO bid protest in which the protester challenged the Defense Threat Reduction Agency’s evaluation of offerors’ technical and price proposals. The contract at issue, valued at approximately $11 million, was for services related to biological weapons threat reduction in Iraq and Afghanistan.

      Successfully represented the intervenor-awardee, Jacobs Technology, Inc., in a contentious bid protest before the GAO. Among other things, the protester alleged that the Department of the Army engaged in flawed discussions with offerors and that the awardee possessed an organizational conflict of interest. The contract at issue, valued at approximately $50 million, was for a broad range of support services for the Army’s logistics civil augmentation program (LOGCAP).

      Represented the protester in a GAO bid protest challenging the Department of the Army, U.S. Army Materiel Command’s evaluation of the awardee’s proposal. The Army promptly took comprehensive corrective action in response to the protest that we filed. The contract at issue in the protest was valued at approximately $42 million.

      Successfully defended U.S. Department of Veteran Affairs design and construction contract awarded to Birmingham Industrial Construction, LLC. The GAO summarily dismissed the protest in response to a request for dismissal that we filed on behalf of our client.

      Represented the protester in a bid protest challenging the U.S. Army Corps of Engineers’ (USACE) evaluation under a Multiple-Award Task Order Contract (MATOC) solicitation that was set aside for Service-Disabled Veteran-Owned Businesses (SDVOBs). The USACE promptly took corrective action in response to the protest that we filed.

      Successfully defended information technology enterprise support services contract awarded to Chameleon Integrated Services. The contract at issue, which was awarded by the U.S. Department of Defense, Defense Information Systems Agency (DISA), was valued at approximately $170 million.

      Successfully defended contract awarded to Fedcar Company, Ltd. in a bid protest action before the GAO. The contract at issue was awarded by the Department of Veterans Affairs for the lease of a healthcare center in Fayetteville, North Carolina.

      Orion Technology, Inc., et al., B-406769 (2012)
      Successfully represented the protester, Orion Technology, Inc., in a bid protest before the GAO. The contract at issue was a $280 million contract for installation support services at the U.S. Army Garrison -Redstone, Alabama.

      J.C.N. Construction, Inc. v. United States, 107 Fed. Cl. 503 (2012)
      Successfully represented construction contractor J.C.N. Construction, Inc. in bid protest action before the U.S. Court of Federal Claims. The contract at issue in that case involved replacement of HVAC system at the Old Post Office Building in Portland, Maine. This bid protest followed several successful agency-level protests.

Subsequent to the GAO’s conduct of an “outcome prediction” conference with the parties, the agency took corrective action in response to the protest that we filed.

      Represented the protester, Southwind Construction Corporation, in a GAO bid protest challenging the terms of a solicitation issued by the U.S. Army Corps of Engineers for the application of hydraulic dredging methods to transport stockpiled and shoaled sand at a site across the Mississippi River from Reads Landing, Minnesota. The agency took corrective action in response to the protest that we filed.

      Successfully represented the protester, Caddell Construction Company, Inc., in GAO protest challenging the agency’s determination that the awardee satisfied statutory qualification requirements under the Omnibus Diplomatic Security and Antiterrorism Act of 1986.

      Successfully represented the awardee, General Construction Company, LLC, in a bid protest action before the GAO. The contract at issue was awarded by the U.S. Army Corps of Engineers for the demolition and replacement of a timber pier at Pier 23 in Tacoma, Washington.

      Represented contract awardee as intervenor in protest of $54 million information technology support services contract. Successfully convinced the court that the agency's evaluation of corporate experience was not limited to prior contracts of similar scope.

      Involved the successful protest of an Army solicitation limiting helicopter engine repair bidders to the original equipment manufacturer and its authorized maintenance centers.

      Chas. H. Tompkins v. United States, 43 Fed. Cl. 716 (1999)
      Involved a successful court challenge to the agency waiving past performance requirements for the low bidder after denial of the protest by GAO.

      Successful representation of construction contractor, Metcalf Construction Company, Inc., in a high-profile appeal before the U.S. Court of Appeals for the Federal Circuit. Among other things, the case likely set the standard for many years to come on the implied duty of good faith and fair dealing for federal government contracts.

      Moreland Corp. v. United States, 76 Fed. Cl. 268 (2007)
      Successfully represented client in action for wrongful default termination of government lease of a medical clinic in Las Vegas and award of approximately $18 million.

      Jacobs Engineering Group, Inc. v. United States, 434 F.3d 1378 (Fed. Cir. 2006)
      Successfully argued that contractor terminated for convenience was entitled to all of its costs reimbursable under the contract.

      Sterling Millwrights, Inc. v. United States, 26 Cl. Ct. 49 (1992)
      Successful representation of a contractor building a chrome-plating facility for the U.S. Army. The Court overturned a default termination and ruled our client was entitled to recover damages caused from the government's defective design and delays.
